Campus reform number 1 for College messages

In the first few weeks of the Trump administration, a flood of executive actions were seen that should draw attention to American universities and universities: there are big changes. However, the university formation, which is dominated by the left ideology, can prove one of the institutions as the most resistant changes.

Since the new “Grenzzar” Tom Homan commands the immigration and customs authority (ICE) to continue the raid on the deportation of illegal immigrants, there is an early point of view of coordinated efforts by the federal authorities on the authorities ‘authorization on the authorities’ authorization to be requested to enforce the law.

At the end of last week, the University of Houston – Downtown (my employer, hereinafter “UHD”) sent an e -mail that offered our faculty similar instructions. Only when I started examining whether other universities had taken similar steps did I learn that the guidance of my school was almost identical that was offered by Northern Illinois University. Previous reporting of Campus reform showed that these are not the only institutions that offer advice on interaction with ice cream.

Despite its broad spread on my campus, it would be imprecise to describe Uhd’s instructions as a “guideline”. Strangely enough, my university documents confirm in advance that their recommendations do not represent “legal advice”, and I am not aware of this guidance in official guidelines through the usual channels of common governance.

This is not surprising, since the recommendations of our historical practice do not match the interaction with the law enforcement authorities on campus. There were at least three times when law enforcement officers knocked on my classroom door and asked if a specific student was present. In cases where the student was in class, I confirmed this to the official. Then they asked if I would send the student into the hall to meet them. In any case, I kept. I have never received training or instructions to do something else – and I have never received negative feedback from the administration for how I dealt with these situations.

The time of the recommendations therefore suggests that the university has issued the new protocol, since this problem includes Implementation of immigration In particular and compliance with guidelines of the Trump administration in the broader sense.

To be clear, the guidance of my university does not Ask the faculty to defy or resist ice agents. However, it seems to be designed in such a way that it delays their access to certain rooms within the university and complicated the identification of a specific person may be looking for the agent.

For example, my university now advises me that as a faculty member I should apply for an arrest warrant before I enable entry into “limited access” and “limited access” on our public campus. I am also advised to refuse to confirm whether a specific student is in my class. The document stipulates that “(a) employees of employees. . . The long -term precedent states that illegal foreigners are made possible in our constitution. But are non-citizens who are illegal in the country (and so that they are not subject to the full legal rights of the United States), the rights specified in Ferpa and Hipaa? Even if this is the case, the question is whether these rights are sufficient to protect individuals from the federal university campus from the federal university campus.

The UHD documents claim that the “principles” should undermine their recommendations to “ensure legal compliance and at the same time protect the rights and privacy of students, faculties, employees and administrators”. Regardless of where you are in the question of enforcement, these guidelines – which are neither “legal advice” or official university directive – put faculty and employees in a very difficult position.

It is true that my students’ immigration status is not of my business. But also not their legal problems. If the universities expect their employees to intervene in the federal law enforcement activities, they owe them an official guideline that protects their actions when they meet the expectations of campus administrators. A complete legal justification for your “advice” is the least that you can do.
