Court rules Idaho can partially enforce its “abortion trafficking law.”

A federal appeals court ruled Monday that Idaho’s “Abortion Trade Lawwhich prevents adults from “harboring” or “transporting” minors out of state to terminate a pregnancy without their parents’ consent.

The law, the first of its kind in the country, came into effect in May 2023. It was blocked in November of that year after plaintiffs sued the state. say the law restricts fundamental rights.

The Law defines the crime of “abortion trafficking” as assisting in obtaining abortion medication for an incompetent minor by “recruiting, harboring, or transporting the pregnant minor within this state.”

Plaintiff attorney Lourdes Matsumoto and nonprofit groups Northwest Abortion Access Fund and Indigenous Idaho Alliance argued the law prevents them from counseling or sharing information with minors seeking legal abortions out of state, violating the plaintiffs’ constitutional right to freedom expression of opinion violates. They say it also violates the right to travel and the right to free association.

The 9th U.S. Circuit Court of Appeals in San Francisco ruled that “harboring” and “transporting” were not figures of speech and partially lifted the injunction.

In the opinion, Judge M. Margaret McKeown wrote However, “recruitment” represented a “wide range of expressive activities,” which may include “encouragement, advice, and emotional support,” as well as education and information about available medical services. This part of the law remains blocked while the case continues to be heard in court.

McKeown also wrote that Idaho police powers do not extend to abortions performed legally outside the state. Under the Human Trafficking Act, the defendants face at least two years in prison.

Idaho bans abortions in most cases, except for rape and incest and when the mother’s life is in danger.

The law allows the attorney general to file charges if district attorneys choose not to. In a statement, Labrador called the ruling a “tremendous victory.”
