Day 2 of the Tim Herrington Jr. capital murder trial

MEMPHIS, Tenn. (WMC) – Day two of the murder trial of a former University of Mississippi student accused of killing his classmate will take place Wednesday.

Timothy Herrington, Jr. is charged with the murder of Jimmie “Jay” Lee, who was reported missing on July 8, 2022. His body was not found.

A judge declared him dead last month.

Lee studied social work at Ole Miss and was a well-known member of Oxford’s LGBTQ-plus community.

The opening sermons and first day of testimony took place on Tuesday.

In her opening statement, specially appointed prosecutor Gwen Agho told jurors that both Herrington and Lee had sexual contact before Lee went missing.

Prosecutors plan to use testimony from Lee’s mother, Oxford police officers and other witnesses to prove that Lee is no longer alive and that Herrington intended to harm him.

Herrington’s defense attorney, Kevin Horan, however, told jurors that the prosecution was unable to make the case that his client killed Lee.

There are at least 49 witnesses who could be called to testify.

The process is expected to take about two weeks.
