Timothy Herrington’s capital murder trial to begin next week in Oxford | Local

Jury selection is scheduled to begin Monday, Dec. 2, in the capital murder trial of Timothy Herrington.



OXFORD, Miss. (WTVA) – Jury selection in the capital murder trial of Timothy Herrington is scheduled to begin Monday, December 2nd.

The trial will take place at the Lafayette County Courthouse in Oxford. However, jury selection occurs outside the county and is brought to Oxford to testify.

Herrington is accused of murdering Jimmie “Jay” Lee in the summer of 2022 to allegedly hide their romantic relationship.

Lee, a student at Ole Miss, disappeared on July 8, 2022. The whereabouts of Lee’s body remain unknown.

Recently, a judge declared Lee legally dead at the request of Lee’s parents.

Herrington’s attorney, Kevin Horan, filed a motion to dismiss the murder charge on Thursday, November 28th.

He claims the dismissal is justified because the charges do not specifically state the state’s kidnapping law.

Aggravated murder is a charge against someone when the person is accused of killing someone while simultaneously committing another crime – in this case, kidnapping.

He contends that the indictment “fails to list the required section and subsection of the underlying crime of kidnapping, which elevates the alleged crime in this matter to capital murder…”

Anyone found guilty of capital murder in Mississippi also faces the death penalty.

A decision on the application has not been announced.
